^ Prior to 2013, the use of the Lincoln County Process was not actually required for making products identified as Tennessee whiskey. However, on May 13, 2013, the Governor Bill Haslam of Tennessee signed House Bill 1084, requiring the Lincoln County process and the existing requirements for bourbon to be used for products identified as "Tennessee whiskey". As a grandfathering measure, the law exempted one small producer, Benjamin Prichard's.[51][52] As U.S. federal law requires statements of origin on labels to be accurate, and various international trade agreements also codify this requirement, the Tennessee law effectively gives a firm definition to Tennessee whiskey.
